Ai WebSoluions requires that our new customers to read and accept our Terms of Service Agreement (TSA) before allowing any service to be rendered. This Terms of Service Agreement (TSA), provides information and the requirements for the service we offer to you. This Terms of Service Agreement (TSA) applies to customers of Ai WebSoluions web hosting services only. This Ai WebSoluions Terms of Service Agreement (TSA) is effective for all customers as of January 1st, 2006.
For New Hosting Accounts
Domain Name Registration:
We promise to work hard to offer best service and value to you (the Client), and to keep you satisfied. Nevertheless, should you decide to discontinue your hosting service with Ai WebSoluions you may do so without penalty. However, domain names registered through our services will be subject to a $20.00 a year domain registration fee. The domain registration fee is a yearly recurring charge and is non-refundable. Once the registration is processed and entered into the ICANN registry database you (the Client) own the domain name. The registration fees that Ai WebSoluions accrues to register the domain for you (the Client) cannot be cancelled and are non-refundable to us. Once the domain name is purchased, you own it; therefore, Ai WebSoluions cannot refund doamin registration the fees to you, (the Client).
Uptime Guarantee:
Ai WebSoluions does not maintain it’s own independent network. Ai WebSoluions does however purchase and own the service that we provide our customers and is responsible for offering support to our customers. Ai WebSoluions strives to maintain a 99% network and server uptime service level. This uptime percentage is a monthly figure, and is calculated solely by Ai WebSoluions, monitoring systems, or by an authorized/contracted outside monitoring service. If Ai WebSoluions fails to meet it's 99% uptime guarantee, and it is not due to one of the exceptions below, credits will be made available to each client upon request on a case-by-case basis. Ai WebSoluions does not credit a full month's service for minor downtime. Truthfully this would not be financially feasible for Ai WebSoluions, and in turn would only negatively impact the overall service level Ai WebSoluions provides you. Any credits given, for this reason, will be determined solely by Ai WebSoluions, and not the customer. In extreme circumstances, Ai WebSoluions may distribute a full months credit, but this would be dealt with on a case-by-case basis.
Uptime Guarantee Exceptions:
The customer shall not receive any credits under this TSA in connection with any failure or deficiency of the Ai WebSoluions network caused by or associated with the following:
Circumstances beyond reasonable control including and without limitation acts of any governmental body, war, insurrection, sabotage, embargo, "Acts of God" (ie...fire, flood, earthquake, tornado, etc...), strike or other labor disturbance, interruption of or delay in transportation, unavailability of or interruption or delay in telecommunications or third party services, failure of third party software or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of the Terms of Service Agreement. Nor shall Telco Failure (ie...Verizon™ cutting a fiber line somewhere), Backbone peering point issues (ie...UUnet™ having a router go down in Virginia that wipes out internet service for the entire East Coast), scheduled maintenance for hardware/software upgrades, hardware failure (faulty hardware is rare, but cannot be predicted nor avoided. Ai WebSoluions through utilizes only name brand hardware to ensure the highest quality and performance.), software bugs/flaws (Expolits and bugs may develop that cause security issues or downtime), DNS issues not within the direct control of Ai WebSoluions, or network floods, hacks, or attacks from outside parties or individuals.
Ai WebSoluions’s goal is to make the Ai WebSoluions network available to the Client free of outages for 99% of the time. An “outage”is defined as an instance in which Client is unable to transmit and receive IP packets due to an Ai WebSoluions service failure for more than 15 consecutive minutes, excluding service failures relating to Ai WebSoluions scheduled maintenance and upgrades. The Ai WebSoluions network does not include client premises equipment or any Telco access facilities connecting the Client's premises to such infrastructure. Ai WebSoluions’s goal is to keep Average Packet Loss on Ai WebSoluions network to 1% or less. Ai WebSoluions defines “Average Packet Loss”, with respect to a given month, as the average percentage of IP packets transmitted on the Ai WebSoluions network during such month that are not successfully delivered, as measured by Ai WebSoluions. Credits:
Credit requests must be made by sending an e-mail to support@aiwebsoluions.com. Each request, in connection with network/server outages/downtime, must be received by Ai WebSoluions within 3 days of the occurrence. The amount of the Credit will be determined by Ai WebSoluions and will not exceed the hosting service fees paid by the Client for a given month. Each validly requested credit will be applied to a Client invoice within 60 days after Ai WebSoluions’s receipt of such request.
Account Cancellations:
Your account can be cancelled ONLY by requesting a service cancellation by sending an e-mail to support@aiwebsoluions.com. The e-mail must come from the registered e-mail address and contact person we have on record for the account. Other methods of cancellation are not valid and will not be recognized. Once the request to cancel the account has been received, the account will be cancelled within 48 hours.
Net Abuse Policy:
Ai WebSoluions reserves the right to refuse service at any time in response to abuse of our network. Ai WebSoluions defines abuse as anything that is illegal and/or degrades the network such as to affect other users of Ai WebSoluions or the network in general. Ai WebSoluions feels that Spam in any form, including but not limited to, unsolicited commercial email, IRC messages, and newsgroup postings is a serious abuse of the network and will not be tolerated. Any misuse of the Ai WebSoluions network in this manner is grounds for the immediate suspension of the Client account and termination/refusal of service. Any suspected abuse will be investigated solely by Ai WebSoluions. If you choose to abuse the network or defame Ai WebSoluions in any way, your domain name will be immediately deleted from our servers.
Right of Refusal of Service:
Ai WebSoluions reserves the right to refuse or discontinue service to Client at our sole discretion. We may deny you access to all or part of the service without notice if you engage in any conduct or activities that Ai WebSoluions in its sole discretion believes violates any of the terms and conditions contained herein this Terms of Service Agreement (TSA). Ai WebSoluions shall have no responsibility to notify any third-party providers of services, merchandise, or information, nor any responsibility for any consequences resulting from such discontinuance or lack of notification.
Hosting Plans: The Ai WebSolutions AdvanTage Hosting Plan is a recurring monthly fee of $35.00/mo for 1GB Web Space and 10Gb bandwidth which includes quarterly updates for your website. The Ai WebSolutions AdvanTage Hosting Plan +Plus is a recurring monthly fee of $45.00/mo which includes all of the above +Plus monthly updates for your site.
The Ai WebSolutions AdvanCed Hosting Plan is a recurring monthly fee of $45.00/mo for 2GB Web Space and 20Gb bandwidth which includes quarterly updates for your website. The Ai WebSolutions AdvanCed Hosting Plan +Plus is a recurring monthly fee of $55.00/mo which includes all of the above +Plus monthly updates for your site.
The Ai WebSolutions Enterprise Hosting Plan is a recurring monthly fee of $60.00/mo for 10GB Web Space and 100Gb bandwidth which includes quarterly updates for your website. The Ai WebSolutions Enterprise Hosting Plan +Plus is a recurring monthly fee of $70.00/mo which includes all of the above +Plus monthly updates for your site.
Hosting plan prices are subject to change without notice.
Website Updates:
Updates are loosely defined as, but not limited to, text/paragraph changes, basic image changes, calendar changes, and simple alignment changes. More involved/complicated updates may be subject to additional design charges subject to Ai WebSolutions and its employee's discretion. A site re-design would not be considered an update to the site and would not be included as part of a quarterly or monthly update. Any site redesign would be subject to current website design fees at the time.
Website Design & Design Services:
Complete website design services will be charged at a minimum of $500 per website. Partial website design will be charged at our current hourly design rate. Ai WebSolutions does not charge by the page for design, we charge by the hour. Our current hourly rate for design services is $43 an hour. The hourly design rate is subject to change without notice. The initial design of a website is estimated to take 10-12 hours of consultation and design to complete. Any design work completed over the initial 12 hours will be charged at our current hourly design rate.
Legal:
Ai WebSoluions Hosting Services may only be used for lawful purposes. Any use of these services, which violates any local, state, federal, or international laws that may apply to Ai WebSoluions, your local jurisdiction, or any jurisdiction that you or your site may be subject to is strictly prohibited. Any attempted use of this service that violates the above conditions is also grounds for immediate suspension, termination, and refusal of service.
You agree to indemnify, defend, and hold harmless Ai WebSoluions from any and all liability, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action or claims caused by or resulting directly and/or indirectly from your use of the service which damages either you, Ai WebSoluions, or any other party or parties without limitation or exception. This indemnification and hold harmless agreement extends to all issues associated with your account at Ai WebSoluions.
You agree that you as the person legally responsible for the use of the URL to which your host name points and are at least 18 years of age or have your parent's or legal guardian's permission before using our service.
This agreement supersedes any written, electronic, or oral communication you may have had with any other web/website hosting company or any agent or representative thereof, and constitutes the complete and total agreement between the parties.
If any provision of this agreement is determined to be invalid or unenforceable, all other provisions shall remain in full force and effect and said provision shall be reformed only to the extent necessary to make it enforceable.
Miscellaneous Items:
Ai WebSoluions makes no warranties or representations of any kind for the services being offered. The service is provided on an "as is" and "as available" basis without warranties of any kind. If you are dissatisfied with Ai WebSoluions or any of its terms, conditions, rules, policies, guidelines, or practices, your sole and exclusive remedy is to discontinue using the service. Any change made to this TSA will be posted on this page of the Ai WebSoluions website.
General:
Ai WebSoluions reserves the right to change or modify these terms of service to benefit the Client, and will post changes to location currently housing this TSA at time of modification, which will be made available to the Client. Specific terms and/or points of this TSA may be adjusted on a case-by-case basis according to the specific Terms of Service signed and/or agreed upon by the Client. In case of difference between the information on the Ai WebSoluions website and this TSA, this TSA will take precedence over the website.
